Privacy Policy:

I, as the “responsible party,” take the protection of your personal data very seriously. Therefore, I treat your personal data confidentially and in accordance with legal data protection regulations. Nevertheless, data transmission over the Internet (e.g., communication by email) can have security vulnerabilities. Complete protection of data from access by third parties is not possible.

If you want to view and use my services, various personal data will be collected.
Personal data refers to data with which you could be personally identified. The following data protection information explains which data I collect, for what purpose I use it, and how the data processing is carried out.

Jotform
I use the service "Jotform," which enables me to create online forms to collect messages, inquiries, and other inputs from interested users of my services. All entries you make are processed on the servers of Jotform. The provider is Jotform Inc., 4 Embarcadero Center, Suite 780, San Francisco, CA, USA.

Note on data transfer to the USA
Since Jotform is a service provider based in the USA, I explicitly point out that the data protection standards in the USA do not match those of the European Union (EU), which means there is always a risk that US authorities may gain access to your data. It is not clear if, which, or for what purpose authorities access your data. It cannot be ruled out that US authorities (e.g., intelligence services) may process, analyze, and store your data located on US servers for surveillance purposes on a permanent basis, without you, as the affected person, being able to take legal action against this. I have no influence over these processing activities.

Legal basis
I use Jotform based on your explicit consent (Art. 49 para. 1 lit. a GDPR), for example, when you enter your data in my form. If you have consented to the storage of cookies or access to information on your device (e.g., via device fingerprinting), data processing is also based on § 25 para. 1 TTDSG. Your consent can be revoked at any time.

In addition, I use Jotform to carry out pre-contractual measures or fulfill a contract (Art. 49 para. 1 lit. b GDPR).

Storage duration
The data you enter in the form will remain with me until you request its deletion, revoke your consent to storage, or the purpose for data processing no longer applies (e.g., after your inquiry has been fully processed).
Other mandatory legal retention periods (e.g., tax or commercial law retention obligations) remain unaffected.

Data processing agreement
I have concluded a data processing agreement (DPA) with Jotform. This is a contract required by data protection law under Art. 28 GDPR, which ensures that Jotform processes the personal data of my prospective clients only according to my instructions and in compliance with applicable data protection regulations (including the GDPR). Since data may be transferred to the USA, the DPA also includes the EU Standard Contractual Clauses.
Details can be found here: https://www.jotform.com/gdpr-compliance/dpa/

SSL encryption
Jotform uses SSL encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries you send to me. You can recognize an encrypted connection by the browser’s address bar changing to “https://” and by the lock icon in your browser.

Your Rights as a Data Subject
You have the right at any time to:

  • Access (Art. 15 GDPR): Request information about your personal data processed by me. This includes details about the purposes of processing, the categories of personal data, the recipients or categories of recipients to whom your data has been or will be disclosed, the intended storage duration, the existence of rights to rectification, erasure, restriction of processing or objection, the right to lodge a complaint, the source of your data if not collected by me, and the existence of automated decision-making including profiling and, if applicable, meaningful information about its details.

  • Rectification (Art. 16 GDPR): Request the immediate correction or completion of incorrect or incomplete personal data stored by me.

  • Erasure (Art. 17 GDPR): Request the deletion of your personal data stored by me, unless processing is necessary for exercising the right of freedom of expression and information, compliance with a legal obligation, reasons of public interest, or the establishment, exercise, or defense of legal claims.

  • Restriction of Processing (Art. 18 GDPR): Request the restriction of processing of your personal data if you contest the accuracy of the data, the processing is unlawful and you oppose its erasure, I no longer need the data but you require it for legal claims, or you have objected to processing pursuant to Art. 21 GDPR.

  • Data Portability (Art. 20 GDPR): Receive your personal data that you have provided to me in a structured, commonly used, and machine-readable format, or request the transmission of this data to another controller.

  • Objection (Art. 21 GDPR): Object to the processing of your personal data based on Art. 6(1)(e) or (f) GDPR on grounds relating to your particular situation, including profiling based on those provisions. You can find the specific legal basis for processing in this privacy policy. If you object, I will no longer process your affected personal data unless I can demonstrate compelling legitimate grounds that override your interests, rights, and freedoms, or the processing serves the establishment, exercise, or defense of legal claims.
If your personal data is processed for direct marketing purposes, you have the right to object at any time to such processing, including profiling related to direct marketing. If you object, your personal data will no longer be used for these purposes.

  • Withdrawal of Consent (Art. 7(3) GDPR): Withdraw any consent you have given at any time. This means that I may no longer continue data processing based on that consent in the future.

  • Right to Lodge a Complaint (Art. 77 GDPR): Lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work, or place of the alleged infringement. This is without prejudice to any other administrative or judicial remedy.
